Any legal suit, action, or proceeding arising out of or related to the Terms of Use or this website shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the City of Los Angeles, and County of Los Angeles, although Dr. Ashley Ebbert, A Psychological Corporation, retains the right to bring any suit, action or proceeding against You for breach of these Terms of Use in Your country or county of residence, or any other relevant country or county. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue in such courts.
Arbitration
If You have any issue or dispute with Dr. Ashley Ebbert, A Psychological Corporation, You agree to first contact ashley@drashleyebbert.com and attempt to resolve the dispute informally. If the dispute is not able to be resolved informally, both parties agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to the Terms of Use by binding arbitration by the American Arbitration Association ("AAA") under the Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes then in effect for the AAA, except as provided herein.
Unless both parties agree otherwise, the arbitration will be conducted in Los Angeles County, California. Each party will be responsible for paying their respective AAA filing, administrative, and arbitrator fees in accordance with AAA rules. The award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys' fees, and reasonable costs for expert and other witnesses, and any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the service.
All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, and, unless we agree otherwise, the arbitrator may not consolidate more than one person's claims. You agree that, by entering into these terms, you and Dr. Ashley Ebbert, A Psychological Corporation, are each waiving the right to a trial by jury or to participate in a class action.
Limitation on Time to File Claims
Any cause of action or claim You may have arising out of or relating to the Terms of Use or this website must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.
Waiver
No waiver by Dr. Ashley Ebbert, A Psychological Corporation, or any term or condition set forth in the Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Dr. Ashley Ebbert, A Psychological Corporation, to assert a right or provision under these terms shall not constitute a waiver of such right or provision.

The Terms of Use and Privacy Policy constitute the sole and entire agreement between You and Dr. Ashley Ebbert, A Psychological Corporation, with respect to this website provided, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to this website.
Changes to the Terms of Use

All changes are effective immediately when posted and apply to all access to and use of this website thereafter.
